Welcome to Navya.
These Terms of Service (“Terms”) govern your access to and use of the Navya website and your purchase of products from Navya (“Navya”, “we”, “us” or “our”).
By accessing our website, browsing our products, creating an account, or placing an order, you acknowledge that you have read, understood and agreed to these Terms, together with our Privacy Policy, Shipping Policy and Return and Refund Policy.
Navya operates as an online fashion retailer offering contemporary Indian wear and related products. Our website is hosted on Shopify, which provides the e-commerce platform through which we offer our products and services.
1. PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, images, colours, measurements, prices and other information displayed on our website are accurate and current.
As our garments may involve handwork, embroidery, printing, natural fabrics and individual finishing, minor variations in colour, texture, placement of embellishment or finish may occur. Such variations may be inherent to the nature of the product and do not necessarily constitute a defect.
The actual colour of a product may also vary slightly depending on your device or screen settings.
2. MADE-TO-ORDER PRODUCTS
Most Navya pieces are made to order. This means that production begins after an order is confirmed and the piece is prepared specifically for the customer.
Made-to-order pieces generally require 15–20 days for dispatch from the date the order is confirmed.
The stated timeline refers to dispatch and not necessarily to the date of delivery. Actual delivery time may vary depending on the delivery destination and courier service.
3. EXCLUSIVE PIECES
Our Exclusive Pieces are specially curated pieces and are separate from our made-to-order collection.
Exclusive Pieces are generally dispatched within 7 days of order confirmation.

4. ORDER CONFIRMATION
An order is considered confirmed once payment has been successfully received and an order confirmation has been issued by Navya.
We reserve the right to decline, cancel or limit an order where reasonably necessary, including in circumstances involving an obvious pricing or product-information error, inability to fulfil an order, suspected fraudulent activity, or other circumstances permitted by applicable law.
If Navya cancels an order after payment has been received, any amount paid for the cancelled order will be refunded in accordance with applicable law.
5. PRICING AND PAYMENT
All prices displayed on the website are in Indian Rupees (INR), unless otherwise stated.
Applicable taxes and shipping charges, where applicable, will be displayed during checkout.
We reserve the right to correct pricing, product information or other errors on the website. If an error affects an order that has already been placed, we will contact the customer and take appropriate action in accordance with applicable law.
6. SHIPPING AND DELIVERY
Navya ships orders to the delivery address provided by the customer at checkout.
Made-to-order pieces generally require 15–20 days for dispatch.
Exclusive Pieces generally require up to 7 days for dispatch.
Once an order has been dispatched, delivery time will depend on the destination, courier partner and other circumstances beyond Navya’s reasonable control.
Customers are responsible for providing a complete and accurate delivery address and contact information. Navya will not be responsible for delays or failed deliveries caused by incorrect or incomplete information provided by the customer.

7. SHIPPING CHARGES AND INTERNATIONAL ORDERS
Applicable shipping charges, if any, will be displayed at checkout before the order is completed.
For international orders, the customer may be responsible for customs duties, import taxes, local taxes or other charges imposed by the destination country. Such charges are outside Navya’s control and are the responsibility of the customer unless otherwise expressly stated by Navya.
Customers placing international orders are responsible for ensuring that the products can legally be imported into their destination country.
8. CANCELLATION, RETURNS AND REFUNDS
Because most Navya pieces are made to order, cancellation, return or exchange requests may be subject to the conditions stated in our Return and Refund Policy.
Nothing in these Terms is intended to exclude or restrict any rights or remedies available to consumers under applicable law.
If a product is defective, damaged, deficient, materially different from the product described, or otherwise covered by applicable consumer protection requirements, please contact Navya promptly so that we can review the matter and provide an appropriate remedy in accordance with applicable law.

9. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS
If you receive a product that appears damaged, defective or incorrect, please contact us at contact@navyastudio.com as soon as reasonably possible.
Please provide your order number and clear photographs or videos of the product and packaging where applicable. This information helps us assess the issue and determine the appropriate resolution.
10. PRODUCT CARE
Customers are responsible for following the care instructions provided with their products.
Navya will not be responsible for damage resulting from improper washing, cleaning, ironing, storage, handling or other care contrary to the care instructions provided with the product.
11. ACCURACY AND AVAILABILITY
We make reasonable efforts to keep our website, product information and inventory information accurate.
However, we do not guarantee that the website will always be available, uninterrupted, error-free or completely accurate.
Products may become unavailable due to production limitations, material availability or other circumstances. If an ordered product cannot reasonably be fulfilled, we will contact the customer and provide an appropriate resolution in accordance with applicable law.
12. INTELLECTUAL PROPERTY
All content appearing on the Navya website, including but not limited to the Navya name, logo, photographs, product imagery, designs, graphics, written content, layout and visual identity, is owned by or licensed to Navya and is protected by applicable intellectual property laws.
You may not reproduce, copy, modify, distribute, publish, sell, commercially exploit or otherwise use Navya’s content or intellectual property without our prior written permission.
13. WEBSITE USE
You agree to use the Navya website only for lawful purposes.
You must not attempt to interfere with the operation or security of the website, introduce malicious software, gain unauthorised access to any part of the website, or use the website in a manner that may harm Navya or other users.
14. CUSTOMER ACCOUNTS
If you create an account with Navya, you are responsible for maintaining the confidentiality of your account information and for activities carried out through your account.

17. FORCE MAJEURE
Navya shall not be responsible for delays or failure to perform its obligations where such delay or failure results from circumstances beyond our reasonable control, including natural disasters, acts of government, strikes, transportation disruptions, courier delays, war, civil disturbance, epidemic, pandemic, technical failures or other force majeure events.
Where such circumstances affect an order, Navya will make reasonable efforts to communicate with the affected customer and provide an appropriate resolution.
18. CHANGES TO THESE TERMS
Navya may update these Terms from time to time to reflect changes to our business, products, services or applicable legal requirements.
The updated version will be published on this page with the revised “Last Updated” date. Your continued use of the website after an update constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
19. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and interpreted in accordance with the laws of India.
Subject to applicable consumer protection laws and the jurisdiction available to consumers under applicable law, disputes arising in connection with these Terms or your use of the website shall be subject to the jurisdiction of the courts having appropriate jurisdiction in Nagpur, Maharashtra.
